Joseph Irungu alias Jowie Irungu has been handed a death sentence for the murder of businesswoman Monica Kimani. In a candid judgement read by Justice Grace Nzioka, the court put into consideration the sacred Right to life while delivering its judgement.

According to the court, both Jowie Irungu(the accused) and Monica Kimani(the victim) had a right to live and either of the lives was/is not supposed to be cut short with no good reason.

During her judgement, Justice Grace Nzioka further  while referring to previous judgement that Jowie remains guilty, said the ‘gruesome’ murder was intentional as it was carefully planned before execution. She asserts that the killer, Jowie, conducted the murder as a professional with an intention of instantly taking life out of Monica Kimani.

She went ahead to point out the conflicting characters of Jowie as issued by his family and court finding. On one hand, Jowie is portrayed as a Social and spiritual person and on the other hand, the court found him guilty of murder, an observation she says the court took keen note of when considering appropriate judgement.

Nzioka who passionately handed the judgement, took a look at a reading from the Holy Book,Bible,  from the book of Job before delving on Murder quotes.

“In the act of murder, one person’s life end and countless lives are forever impacted…Murder leaves behind a trail of shuttered dreams and broken hearts that can never be healed…The act of murder is henious crime that challenges fabrics of society and demand justice”

“I have taken into account issues of Human Rights that a person’s life should not be taken with no good reason… The murder was intentional. It wasn’t  defensive or out of provocation. It was planned, intended and executed”she partly said before delivering the judgement

She also stated the detrimental effects the case has had on the family of deceased. Nzioka said Monica’s family business died while her mum suffered depression and stroke. She thus sentenced Jowie to death.

“In this case, it is undisputed that the deceased was the Managing Director of the family business in South Sudan. It is undisputed that the business collapsed after her demise and that it was the source of income for the family and we can all appreciate the natural and probable consequence of that”

“Based on what I have said, I have ordered that the first accused before this court, Joseph Kuria Irungu alias Jowie, shall suffer death as provided for the offence of murder under section 204 of the penal code of Kenya. That is the order of the court.”Nzioka said

In a judgement read last month, Justice Nzioka declared Jowie guilty of the murder.

“Having considered the evidence in this matter it is the finding of this court that the prosecution has adduced adequate evidence and has met the threshold… It is the finding of this court that the first accused person murdered the deceased,”Nzioka read.
