Two Men Sue Condom Company After Contracting HIV
Two men, Joseph Kintu and Sulaiman Balinya have sued a reproductive health company for allegedly distributing ‘fake’ condoms.
The two Ugandan nationals claim they used the condom but still contracted HIV and gonorrhea.
Kintu states that he bought a packet of Life Guard condoms batch No 1904205 from a drug shop on October 1, 2019, to protect himself against any sexually transmitted infection but the condom bursted hence exposing him to risk related to unprotected sex.
“Having tested HIV negative twice before; in June and September 2019, I tested HIV positive on November 6, 2019,” Kintu narrates in his affidavit before the court.
Balinya, a regular condom user, also bought the same condoms on the same date with a different batch number from Shifa Pharmacy using them on the same night, but realised the condom had bursted and was leaking after completing the act.
He however kept the remaining condoms for future use.
“On October 24, 2019, he felt lots of pain in his (Balinya) private parts, went to Ruhooko Health Centre IV for treatment where he was tested and diagnosed with gonorrhoea and put on treatment,” the court document reads.
They would later learn through the media that the said batch of Life Guard condoms had been recalled by Uganda’s National Drug Authority (NDA) for being defective and having been illegally distributed.
