Former Riara Group of Schools teacher is a happy guy after the Employment and Labour Court ruled in his favour terming his dismissal as unfair.

 

The teacher identified as Apollo Amanya was dismissed from work due to allegations of sharing pornographic pictures and videos to senior members of his staff in breach of the school e-learning policy.

 

The art teacher was contracted by the school on June 10, 2019 and was fired on March 18,2021 upon sending the contents to the senior staff.

 

 

The labour Court on its part agreed that yes sharing the graphic content was a wrong act, but dismissing in a such a manner was unlawful.

 

 

“The images circulated were, to say the least startling. The court shudders at the thought of such materials finding their way to the young learners within the institution. It is shocking that a teacher would find it appropriate to engage in the circulation of such materials, particularly in an institution of learning,” said Justice Bernard Manani.

 

 

The judge however stated that despite the school management having every right to fire the teacher, the school failed to convince the court that it upheld the requirements of due process in terminating his job.

 

 

Mr.Apollo was awarded shs.110,000 equivalent to his two months salary as compensation for wrongful firing.
