Assistant Chief Jailed For 40-years For Defiling, Impregnating Minor

A Kabarnet Court has sentenced a former Kasaka Assistant Chief to 40 years in jail after he defiled and impregnated a minor.

Thomas Chesang, 47, who appeared before Kabarnet Senior Resident Magistrate (SRM) Caroline Ateya on Friday, is accused of defiling a standard seven student on various dates between February and August 2021 in Kasaka village, Baringo North Sub County.

Chesang was charged with a second count of committing an indecent act with a child contrary to Section 11(1) of the Sexual Act No. 3 of 2006, but maintained his plea of not guilty, stating that he was framed.

The Senior Resident Magistrate  while delivering the judgement, said that from the testimonies presented before the court, it was established that the minor had suffered serious psychological effects from the ordeal committed by her area assistant chief.

“The aggravating circumstance is that he was a person in authority who made the victim to be placed under witness protection,” the senior resident magistrate read part of the judgement.

The magistrate noted that the victim had even undergone counseling since she was forced to have an illegal abortion in order to conceal evidence.

The Kabarnet SRM said she could not allow a non-custodial sentence for  Chesang given the gravity of the offense, which involved a vulnerable person.

She therefore sentenced Chesang to 40 years in jail and gave him a 14-day period to appeal if he was not satisfied with the judgment.
