A court has fined a woman more than Sh. 10 million for breaching marriage promise.

 

A female teacher Fortunate Kyarikunda before Grade One Magistrate Asanario Mukubi at Kanungu district in Uganda was to marry Richard Tumwine as per the promise but breached the promise.

 

According to court records, the two teachers started their love relationship in 2015 and later entered marriage agreement in 2018.

 

On the process of the serious love, the court also record Mr Tumwine financially supported Fortunate’ s education to further her studies in pursuing a diploma in law at the Law Development Center (LDC) where he spent more than Shs. 9.4 million.

 

I note, from the exhibit, several mobile money transfer transactions from the plaintiff’s cell phone in names of Richard Tumwine to the defendant’s cell phone in names of Fortunate Kyarikunda,” the magistrate observed.

However, in February 2022 the time Tumwine was to do his introduction to Kyarikunda’s family, the slated introduction didn’t take place and the lady giving no justifiable reason for the failure.

 

From the exhibit, it is indicated as a budget for introduction for Fortunate Kyarikunda’s parents home and several items worth Sh 5million are indicated on the list and the comments of the defendant appreciating the budget and requesting for more financial support to enable her go to Rubanda is clearly indicated” the Magistrate noted.

Though controversially and less weighted as per the court rule and note, Kyarikunda claimed her parents can’t let her get married to an “old man” referring to the Kiringa Primary School teacher Mr Tumwine.

 

This is equally unreasonable, a misrepresentation and a fraud. In any case, the defendant had all the opportunity to reject the plaintiff’s love requests at the earliest point possible and avoid interfering with his financial obligations” Mr Mukubi said.

 

As per the escalated reasons, Kyarikunda is to re-imburse Shs 9.4 million spent on her to Mr. Tumwine.

 

Moreover, according to Magistrate’s rule, Kyarikunda to pay Shs 1million to Tumwine for general damages including psychological anguish and inconveniences.

 

And because Tumwine spent on filing the lawsuit, Kyarikunda to also pay for the legal prosecution incurred in filing the case by Tumwine.
