President William Ruto has suffered a major blow after the High Courtsuspended the implementation of the Finance Act 2023.

 

Lady Justice M Thande in her ruling said she was satisfied that the petition filed by Senator and activist  Okiya Omtatah met a threshold of receiving conservatory orders.

 

“I am satisfied that the application meets the test of conservatory orders and I do grant prayers 2 and 3 of the application until July 5, 2023, when the matter is scheduled for mention for directions,” Justice Thande ruled.

 

Other petitioners who sought for the Act to be halted are Eliud Karanja Matidi, Michael Kojo Otieno, Benson Odiwuor Otieno, Blair Angima Oigoro, Victor Okuna and Florence Kanyua Lichoro.

 

Cabinet Secretary for National Treasury and Planning  Njuguna Ndung’u, Attorney General Justin Muturi,  The National Assembly and the Speaker of the National Assembly Moses Wetangula were listed as respondents in the case.

 

The Bill became an Act after 184 against 88 MPs voted to pass the Bill before the President assented on it.
